SmokeEtown Wholesale’s catalog and website are intended for wholesale customers who are 21 years of age or older. All customers are required to provide a tax/resale identification number prior to their first order.

Laws governing taxes & exemptions vary, and you will be held liable for any tax, interest, and possible penalties imposed by your local jurisdiction if your purchase is not legally exempt or if you fail to pay any due tax. To determine what tax & exemptions are applicable in your particular jurisdiction, please refer to your local tax agency. Smokeetown Wholesale is in compliance with the PACT ACT.

General Policy: All claims must be made with the appropriate brands in case of any personal damages. In no way is Smokeetown Wholesale LLC backing products with any health claims or guaranteeing safety of any product. Smokeetown Wholesale LLC distributes products for Tobacco Use only. It is the buyers responsibility to check local laws for the legality of merchandise in his/her state. It is the buyers responsibility to understand the dangers as well as the proper procedures for handling all batteries. It is buyers responsibility to pay all state taxes and any tobacco taxes that their state may levy.

Return Policy: ALL SALES ARE FINAL. Only manufacturer defects or items damaged during shipping will be authorized for a credit. Smokeetown Wholesale LLC follows strict policy of no returns & exchange. Smokeetown Wholesale LLC is not responsible for any changes in governmental laws or policies. There will be no products accepted for returns or credit in any circumstance. Damaged or missing items must be reported within 48 hours of delivery. All other products must be returned to Smokeetown Wholesale LLC within 48 hours from invoice date. Unless any faults of Smokeetown Wholesale LLC, all returned items will incur a restocking fee of 15% and customer will be responsible for any/all shipping charges. Unauthorized returns will not be credited or re-shipped.

Buyers Guarantee: Buyer personally guarantees all purchases made at Smokeetown Wholesale LLC. Any and all payment forms are backed by buyer's own person. All bad-checks will incur a fees of $50, and Smokeetown Wholesale LLC holds the right to refuse any future sales. In case of non-payment, Smokeetown Wholesale LLC holds the right to legally pursue buyer's corporation as well as buyer's own person for all the damage/loss incurred. Seller is not liable for any incidental, consequential or special damages, interest, costs or expenses, or for loss of use, loss of data or lost profits or wages, whether or not Seller knew such damages might be incurred. Seller’s liability is in all cases limited to refunding the purchase price or current value of the services, at Seller’s option. In the event it becomes necessary for the Seller to incur any collection costs or suits to collect payment, the Buyer will be responsible for all such costs, including but not limited to court costs, attorney fees and collection agency fees on said collection/suit. Smokeetown Wholesale LLC warrants to you that Smokeetown Wholesale LLC shall use its reasonable endeavors to provide the services with reasonable care and skill and, as far as reasonably possible, in accordance with your request and instructions from time to time. Where Smokeetown Wholesale LLC supplies you with any goods or services supplied by a third party, then Smokeetown Wholesale LLC is acting as your agent in sourcing the goods or services. Smokeetown Wholesale LLC will use reasonable care in selecting the supplier and ensuring the order is placed in accordance with your wishes. All sales are final, unless otherwise agreed by the supplier, vendor or partner, you shall not be entitled to cancel the service requested where, on your instructions, performance has already begun. Smokeetown Wholesale LLC is not liable for any incidental, consequential or special damages, interest, costs or expenses, or for loss of use, loss of data or lost profits or wages from the sale, use or consumption of the products sold, whether or not Smokeetown Wholesale LLC knew such damages might be incurred. Smokeetown Wholesale LLC’s liability is in all cases limited exclusively to refunding the purchase price or current value of the products, at Smokeetown Wholesale LLC’s discretion.
